Please review the terms and conditions that govern your use of the Dr. Vaccaro Counseling Group, PLLC website and services. These terms help establish clear expectations and protect both our clients and practice.
Acceptance of These Terms
These Terms of Service (“Terms”) govern your use of the website at https://drvaccarocounseling.com (the “Website”), operated by Dr. Vaccaro Counseling Group, PLLC (“we,” “us,” or “the Practice”). By using the Website, you agree to these Terms. If you do not agree, do not use the Website.
About the Practice
We are a mental health practice located in Rockwall, Texas, providing individual, couples, family, play, and teletherapy services, concierge consulting, and psychological and forensic evaluations. Our clinicians are licensed by the State of Texas.
No Medical Advice and No Provider Relationship Through the Website
The Website is for general informational purposes only. Content on the Website, including blog posts, does not constitute medical, psychological, or professional advice and is not a substitute for care from a qualified provider.
Using the Website, submitting the contact form, or contacting us does not create a therapist client, provider patient, or evaluator examinee relationship. That relationship begins only after intake is completed and a clinician formally accepts you as a client through our secure systems.
Emergencies
The Website is not for emergencies. If you or someone else is experiencing a mental health emergency, are in danger, or are considering harming yourself or others, do not use the Website or contact form. Call or text 988 (Suicide and Crisis Lifeline), call 911, or go to your nearest emergency room.
Communication and Appointment Requests
If you submit the contact form, you agree to be contacted by our office via phone, text, and email. Do not include health information, symptoms, or other sensitive details in the contact form, because it is not a secure channel. Secure clinical communication takes place through our client portal (SimplePractice).
SMS Terms and Conditions
Product Description. By providing your mobile phone number, you consent to receive SMS messages from Dr. Vaccaro Counseling Group, PLLC regarding appointment reminders, scheduling, and account notifications. These messages are transactional only; we do not send marketing or promotional text messages.
Message Frequency. Message frequency may vary.
Message and Data Rates. Standard message and data rates may apply.
Opting Out. You may opt out at any time by replying STOP to any SMS message you receive from us. After opting out, you will receive a confirmation message, and we will cease sending SMS messages to your number.
Help and Support. If you need assistance or have questions about our SMS service, reply HELP to any SMS message you receive, or contact our office at (469) 887-1633 or admin@drvaccarocounseling.com.
Privacy. Your phone number will be handled in accordance with our Privacy Policy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Telehealth
We offer telehealth services in addition to in person care. Telehealth is delivered through HIPAA compliant platforms and is subject to a separate telehealth consent you will complete as part of intake. Telehealth is available only to clients located in states where our clinicians are licensed to practice at the time of service.
Evaluation and Forensic Services
This section is important. Our practice provides psychological evaluations and forensic services, including child custody evaluations, that are different from therapy and are governed by different rules:
- A forensic or evaluation engagement does not create a treating therapist relationship and is not therapy.
- Information shared during an evaluation is generally not confidential in the way therapy is. Reports and findings may be disclosed to courts, attorneys, or other parties as defined in the engagement agreement and as required by law.
- The evaluator’s role is to provide objective, independent opinions, not to advocate for any party.
- The specific scope, confidentiality limits, fees, and disclosure terms for any evaluation are set out in a separate written agreement that controls over these Terms for that engagement.
If you are seeking an evaluation, review and sign the applicable evaluation agreement before services begin.
Payment and Billing
Fees, payment terms, and autopay arrangements are managed through our practice systems (SimplePractice and, for insurance based services, Headway) and are described in the agreements you sign during intake. One clinician participates with insurance through Headway; other clinicians are self pay. Cancellations require at least 24 hours advance notice. Appointments cancelled with less than 24 hours notice, or missed without notice, may be subject to a fee as described in the service agreement you complete during intake.
Third Party Services
The Website and our operations rely on third party platforms, including GoDaddy (hosting), Google reCAPTCHA (form security), SimplePractice (records, scheduling, portal, telehealth, payments), and Headway (insurance billing). Your use of those platforms may be subject to their own terms and policies.
Intellectual Property
All content on the Website, including text, graphics, logos, and images, is owned by or licensed to the Practice and is protected by applicable law. You may not copy, reproduce, or distribute Website content without our written permission, except for personal, non commercial use.
Acceptable Use
You agree not to use the Website to: violate any law; transmit harmful code; attempt to gain unauthorized access to our systems; interfere with the Website’s operation; or submit false or misleading information.
Disclaimers
The Website is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of accuracy, reliability, or fitness for a particular purpose. We do not warrant that the Website will be uninterrupted, secure, or error free.
Limitation of Liability
To the fullest extent permitted by law, the Practice and its clinicians, owners, and staff will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Website. This section does not limit any liability that cannot be limited under applicable law, including the professional obligations of our clinicians to clients under an established care relationship.
Indemnification
You agree to indemnify and hold harmless the Practice and its clinicians, owners, and staff from claims arising out of your misuse of the Website or violation of these Terms.
Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute relating to the Website or these Terms will be brought in the state or federal courts located in Rockwall County, Texas, and you consent to that jurisdiction.
Changes to These Terms
We may update these Terms at any time. The current version will be posted on this page with an updated effective date. Continued use of the Website after changes means you accept the revised Terms.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
